The aim of the focus campaign on cosmetics and toys from online trade was to ensure compliance with the mandatory designation of an economic operator based in the EU, the "EC Rep" (European Authorised Representative), as stipulated in Article 4 of the Market Surveillance Regulation (EU) 2019/1020. Otherwise, such products that are offered from non-EU countries via the Internet may not be placed on the EU market.
A total of 22 products were analysed, with some platforms indicating several "EC Reps" for each product. Confirmatory feedback on the responsibility of the responsible person was received for ten of the 22 products. 8 alleged "EC Reps" did not provide any feedback. A further 4 stated that they were not the "EC Rep" for the specified products. Result: Article 4 of Regulation (EU) 2019/1020 is fulfilled in only 45 per cent of the cases checked.
